1. Agreement to Terms
By accessing and using JoyfulMoment's party planning services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website located at joyfulmoment.site and all services, features, content, and applications offered by JoyfulMoment. If you do not agree to abide by the above, please do not use our services.
2. Service Description
JoyfulMoment provides comprehensive party planning and event coordination services across Canada. Our services include but are not limited to event planning consultation, venue selection, decoration coordination, vendor management, timeline creation, and on-site event supervision. We specialize in birthday parties, corporate events, anniversaries, graduations, holiday celebrations, and other special occasions.
3. Booking and Payment Terms
All event bookings require a signed contract and deposit to secure your event date. Payment schedules are established on a per-event basis and outlined in your individual service agreement. Final payment is due no later than 48 hours before your scheduled event. We accept various payment methods including credit cards, bank transfers, and certified checks. All prices are quoted in Canadian dollars unless otherwise specified.
- Initial consultation fees are non-refundable
- Deposits are required to secure event dates and are applied to final invoice
- Additional services requested during planning may incur extra charges
- Price quotes are valid for 30 days from date of issue
4. Cancellation and Refund Policy
We understand that circumstances may require event cancellations or modifications. Our cancellation policy is designed to be fair while protecting our business interests and those of our vendor partners. Cancellation terms vary based on timing and services contracted.
- Cancellations made more than 60 days before event date: 75% refund of payments made
- Cancellations made 30-60 days before event date: 50% refund of payments made
- Cancellations made 14-30 days before event date: 25% refund of payments made
- Cancellations made less than 14 days before event date: No refund available
- Weather-related cancellations will be handled on a case-by-case basis
5. Client Responsibilities
Successful event planning requires collaboration between JoyfulMoment and our clients. Clients are responsible for providing accurate information, timely responses to planning inquiries, and adherence to agreed-upon timelines. Clients must also ensure all necessary permits, licenses, and approvals are obtained for their events when required by local regulations.
- Provide accurate guest count estimates and dietary restrictions
- Respond to planning communications within agreed timeframes
- Obtain necessary permits for events in public spaces
- Ensure venue access and setup permissions are secured
- Inform us of any changes to event requirements promptly
6. Limitation of Liability
JoyfulMoment's liability is limited to the total amount paid for our services. We are not liable for indirect, incidental, special, consequential, or punitive damages. Our responsibility is limited to the planning and coordination services outlined in your service agreement. We are not responsible for the actions of third-party vendors, venue policies, weather conditions, or circumstances beyond our reasonable control.
7. Intellectual Property
All creative concepts, designs, planning documents, and proprietary methodologies developed by JoyfulMoment remain our intellectual property. Clients receive a license to use these materials for their specific contracted event only. Reproduction, distribution, or commercial use of our proprietary materials without written consent is prohibited.
8. Privacy and Data Protection
We are committed to protecting your privacy and handling your personal information responsibly. Our collection, use, and protection of personal data is governed by our Privacy Policy. We collect only information necessary to provide our services and do not share personal information with third parties except as required for service delivery or as required by law.
9. Force Majeure
JoyfulMoment shall not be held liable for any failure or delay in performance under this agreement which is due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, boycott, pandemic, or other similar events beyond our reasonable control. In such events, we will work with clients to reschedule or modify services as circumstances permit.
10. Dispute Resolution
Any disputes arising from our services will first be addressed through direct negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in accordance with the laws of the province where services were provided. The arbitration will be conducted in English and governed by Canadian law.
11. Modifications to Terms
JoyfulMoment reserves the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the modified terms. We recommend reviewing these terms periodically to stay informed of any updates.
